This Privacy Policy explains how Dolbey and Company, Inc. (“we”) collects, uses, discloses, and safeguards your information when you use the Fusion Narrate Keyboard Application (the “App”).   Please read this Privacy Policy carefully.  IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS OR USE THE APPLICATION.

We reserve the right to make changes to this Privacy Policy at any time and for any reason.  We will alert you about any changes by updating the “Last updated” date of this Privacy Policy.  You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.  

Your installation and use of the App is subject to the terms and conditions of the License Agreement that accompanies the App on the Apple app store (“App License Agreement”).  Pursuant to that App License Agreement, you (or the corporation or other entity on whose behalf you are using the App) must have a current license agreement with Dolbey or a Dolbey authorized reseller to use one or more Fusion Narrate® Products (the “Client Contract”), and you must be registered as an Authorized User pursuant to such Client Contract.  The App connects with the cloud-based speech recognition platform provided to you as an Authorized User under such Client Contract.

Collection of Your Information

We may collect information from and about you in a variety of ways.  The information we may collect via the App may include:

  • Your Personal Data: Your demographic and other personally identifiable information (such as your name, email address, and credentials as an Authorized User of one or more Fusion Narrate products) that you voluntarily give to us when choosing to participate in various activities related to the App, such as registering, sending feedback, and responding to surveys.  In addition, the Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application. 
  • Your User Input: When you use the App, we may capture your voice and the words that you speak or type into the App.  If you use the microphone feature, this data is transmitted to the cloud-based speech recognition platform provided under the Client Contract, and speech recognized text is returned to the window on your device in which you are using the App.  Your voice data and the associated speech recognized text is stored on the cloud-based speech recognition platform in accordance with the applicable terms and conditions of the Client Contract. We do not store the text that you input into the App, your keyboard strokes, or your voice data on your device; likewise, we do not store any speech recognized text on your device unless you select the “Debug Logging” feature.  However, if you use the App to insert text into another application on your device (a “third party application”), you must refer to the terms and conditions governing the use of that third party application and the associated privacy policy for such third party application.  

How We Use Your Information

We use Your Personal Data and Your User Input to deliver, support and improve the App and the Fusion Narrate Product(s) pursuant to the terms and conditions of the applicable Client Contract.  We may also use your Personal Data to deliver promotional material to you, notify you of updates to the App, request feedback from you, and assess your compliance with the terms and conditions of the App License Agreement and applicable Client Contract.

When We Share Your Information

We may share Your Personal Data and Your User Input that is collected by the App and processed within our cloud-based speech recognition platform only to deliver, support and improve the App and the Fusion Narrate Product(s) in accordance with the terms and conditions of the applicable Client Contract.  

Control of Your Information

Your Personal Data and Your User Input that may be stored on the device as part of the App’s logging functionality is not viewable by You.  Logs that are stored on your device will be deleted from your device when you delete the App. For troubleshooting purposes, you may choose to send logs to the cloud-based speech recognition platform by using the App’s “Send Logs” feature.  Your access to Your Personal Data and Your User Input that is transmitted to the cloud-based speech recognition platform, and your ability to retain or delete such information, is governed by the terms and conditions of the applicable Client Contract.  If you contact us with a request concerning access to, retention or deletion of Your Personal Data or Your User Input, we may direct your inquiry to our client or authorized reseller which is a party to the applicable Client Contract.

Security of Your Information

We use reasonable and appropriate safeguards to secure Your Personal Data and Your User Input, both in transit and at rest.  Although we attempt to protect Your Personal Data and Your User Input that is collected via the App, no security system is perfect, and we cannot promise that Your Personal Data or Your User Input will remain absolutely secure in all circumstances.  The applicable Client Contract (including a HIPAA Business Associate Agreement, if any) governs the security of Your Personal Data and Your User Input that is transmitted to the cloud-based speech recognition platform.
